Imagine the scenario that in the future you lose the mental ability to make decisions. Now, whilst you have ability to make decisions, you can choose to either:
- Give someone (can be more than one person) the power to make decisions on your behalf once you’ve lost mental capacity (or sooner, see Property and Financial Affairs); or
- Allow the Public Guardian to make decisions for you once you’ve lost mental capacity
If you give someone power to make decisions, they become your Attorney (another word for representative).
There are two types of LPA, specific to the type of decisions that the Attorney(s) can make:
- Health and Welfare
- Property and Financial Affairs
If you give an Attorney the power to make decisions about Health and Welfare, they’ll be able to step in when decisions need making about:
- Your daily routine, for example washing, dressing and eating
- Medical care
- Moving into a care home
- Life-sustaining treatment
Remember, these decisions can only be made by the attorney(s) when it is established that you cannot make your own decisions. If you can make your own decisions, attorney(s) cannot make them for you against your will.
If you give an Attorney the power to make decisions about Property and Financial Affairs, they’ll be able to step in when decisions need making about:
- Managing a bank or building society account
- Paying bills
- Collecting benefits or a pension
- Selling your home
Unlike Health and Welfare, the Property and Financial Affairs LPA can be used before mental capacity is lost providing the attorney has permission to help.
